This article focuses on the interrelationship of law and life in human rights. It does this in order to theorize the normative status of contemporary biopower. To do this, the case law of Article 2 on the right to life of the European Convention on Human Rights is analysed. It argues that the juridical interpretation and application of the right to life produces a differentiated governmental management of life. It is established that: 1) Article 2 orients governmental techniques to lives (...) in order to ensure that both deprivation and protection of lives is lawful; 2) A proper application of Article 2 grounds itself on a proper discrimination of lives which causes Article 2 to be applied universally but not uniformly to all juridical subjects; 3) The jurisprudence of Article 2 is theoretically appreciable only in a ‘politics of life’. Finally, the article ends with a plea to analyse other fundamental human rights in the context of ‘biopolitical governmentality’. (shrink)

I suggest that virtue ethics can learn from Foucault’s critical observations on biopolitics and governmentality, which identify how a good cannot be disassociated from power and freedom. I chart a way through which virtue ethics internalizes this critical point. I argue that this helps address concerns that both virtue ethics and the critical scholarship inspired by Foucault otherwise ignore. I apply virtue ethics to the contexts of refugee arrival, asylum procedure, and immigrant integration in Western Europe; I then see how (...) Foucault’s critical thought provides a counterpoint to virtue ethics; I finally analyze how incorporating that critique allows virtue ethics to make sense of both the context and the stakes involved. The safety condition is supposed to be a necessary condition on knowledge which helps to eliminate epistemic luck. It has been argued that the condition should be globalized to a set of propositions rather than the target proposition believed to account for why not all beliefs in necessary truths are safe. A remaining issue is which propositions are relevant when evaluating whether the target belief is safe or not. In the literature, solutions have been proposed to determine the relevance of (...) propositions. This paper examines a case of luckily true belief—thus a case of ignorance—and a case of knowledge. This essay focuses on the interrelationship of regulation and private life in human rights. It argues three main points. Article 8 connects the question of protection of private lives and privacies with the question of their management. Thus, Article 8 orients regulatory practices to private lives and privacies. Article 8’s holders are autonomous to the extent that laws respect their private lives and privacies. They are not autonomous in a ‘pre-political’ sense, where we might expect legal rules to protect an (...) already autonomous private life or privacy. Article 8 does not simply prohibit or permit acts. In certain cases, it also ‘enables’ acts. Then, this essay introduces the idea of oikopolitics. This idea allows us to capture these three points in a useful manner. By this idea, this essay means the context where the interpretation of privacy reaches out to broader social practices and norms and where the status of rights-holders living their private lives makes them objects of attention. It has been argued that an advantage of the safety account over the sensitivity account is that the safety account preserves epistemic closure, while the sensitivity account implies epistemic closure failure. However, the argument fails to take the method-relativity of the modal conditions on knowledge, viz., sensitivity and safety, into account. In this paper, I argue that the sensitivity account and the safety account are on a par with respect to epistemic closure once the method-relativity of the modal conditions is (...) taken into account. Objectives: The most principal nutrition source of a bone is nutrient arteries. They are important at every stage of bone development. A nutrient artery enters a bone through the nutrient foramen, the largest hole on the outer surface of the bone. The foramen is important both morphologically and clinically. -/- Methods: A total of 414 adult human dry bones were investigated in this study to identify topographic and morphological features of nutrient foramina in the scapula, clavicle, humerus, radius and ulna. (...) Nutrient foramina were examined with a hand lens. Their dimensions and directions were determined with a 21-gauge needle, and thus major foramina were detected. Positions of nutrient foramina were noted according to surfaces of the bones, and to segments separated as proximal, middle and distal by calculating foraminal index. -/- Results: A single nutrient foramen was found in 71% of our samples. We observed that 94.2% of foramina in the clavicle, 89.3% of foramina in the humerus, 51.3% of foramina in the radius, and 67.7% of foramina in the ulna were located in the middle 1/3 segment of the bones. -/- Conclusion: Our findings were in line with the data in the literature. On account of pathologies associated with the nutrient foramen, our findings may be helpful for surgeons to design applications performed in the region. In addition, we think that our data by contributing to the literature may be a resource for clinicians due to the importance of the nutrient foramen for surgical procedures. (shrink)

According to the sensitivity account of knowledge, S knows that p only if S’s belief in p is sensitive in the sense that S would not believe that p if p were false. The sensitivity condition is usually relativized to belief-formation methods to avoid putative counterexamples. A remaining issue for the account is where methods should be mentioned in the sensitivity subjunctives. In this paper, I argue that if methods are mentioned in the antecedent, then the account is too strong (...) to accommodate inductive knowledge; if methods are mentioned in the consequent, then the account is too weak to eliminate some luckily true beliefs from the realm of knowledge. Therefore, the strategy to relativize the sensitivity condition is undermined by inductive knowledge and some luckily true beliefs. (shrink)

According to the safety account of knowledge, one knows that p only if one’s belief could not easily have been false. An important issue for the account is whether we should only examine the target belief when evaluating whether a belief is safe or not. In this paper, it is argued that, if we should only examine the target belief, then the account fails to account for ignorance of necessary truths. But, if we should also examine beliefs in other relevant (...) propositions, then the account fails to account for knowledge from falsehood. Therefore, the safety account of knowledge is undermined by knowledge from falsehood and ignorance of necessary truths. (shrink)

The article explores the regulatory aspect of the right to freedom of expression. It focuses on human rights case law to see how the guarantee of this right considers subjects, who are required to be free in specific ways in order to exercise their freedoms aptly.

This inquiry examines the question how the category of ‘religion’ generates a complex form of power oriented to the government of subjects. It does this through a critical reading of the right to freedom of religion, offered from the perspective of governmentality. It is argued that the right to freedom of religion enables the rational goals of government to relate to religiosity in such a manner that those subject to them are made at once freer and more governable ‘in this (...) world’. In The Context of Laws of Nature Structural Humeanism vs. Classical Humeanism -/- In the context of the laws of nature, philosophers of science have developed some views in order to adopt an attitude towards recurring events in nature. In this respect, it has been discussed whether there is any driving force underlying the regular behaviours and movements we encounter in nature, and two approaches have emerged as a result of the discussion: A view that there are certain driving forces (...) or causal relations in the ground, and an opposing view that claims that there are no causal relations in the ground, but there are regularities in nature. Views such as the latter are generally described as the Humean view. Such views are also called regularity theories. Throughout this article, the statements referred to as regularity are characterised as the Humean view. Since the article will be centred on the Humean view, views such as the first view, such as dispositional essentialism or structural realism, are not the concern of this article. The article favours the Structural Humean approach over the classical Humean approach. The classical Humean approach is centred on the views of David Lewis and is concerned with distinguishing between laws of nature seen as accidental generalisations and regularities. While it tries to make such a distinction by constructing nature through a mosaic, the Structural Humean approach is an approach that develops Lewis’s claims and tries to shape nature with the concept of structure rather than mosaic. Thus, it is seen as an approach that provides more information than the Classical Humean approach in terms of creating a philosophical infrastructure for explaining nature in terms of modern physics. Through Psillos, Structural Humeanism tried to place the concept of natural pattern into the structure in order to gain metaphysical solidity and tried to bring the Structural Humean approach closer to the Structural Realism camp. Thus, the classically epistemologically important Humean approach has made a significant progress in positioning it on the realist wing. Objective: To determine the prevalence of the accessory sacroiliac joint (ASIJ) on both computed tomography (CT) images and dry bones and ultimately, to contribute to the literature. -/- Materials and Methods: CT images archived in the Radiology department of Gaziantep University Medical Faculty obtained from 145 individuals (104 males and 41 females) as well as 92 sacral bones were examined. -/- Results: The prevalence of ASIJ among 92 sacral bones was 15.2%. The ASIJ was more commonly (52%) located at the (...) posterior portion of the SIJ at the level of the second dorsal sacral foramen. In 48% of the bones, ASIJ was identified just above the first dorsal sacral foramen. Unilateral ASIJ was observed in 10.8% and bilateral ASIJ in 4.4% of the sacral bones. On CT images, ASIJ was found in 7.8% of the males and 7.2% of the females. The total prevalence of sacroiliac joint variations was 28.9%, and 6.8% of them were ASIJs. -/- Conclusion: It should be kept in mind that ASIJ may be a source of arthritis and chronic hip pain. The presence of ASIJ should be sought through imaging studies for early diagnosis of ASIJ. (shrink)

This essay analyses those statements that mention legal norms in negative terms. Specifically, it analyses those statements that define a legal system by mentioning how legal protection does not work and where legal protection ends, and those statements that identify what rights‐holders do not have to with their legally protected free capacities. This essay argues that these statements address a systemic question. It calls such a dynamic as negative governmentality. The argument proceeds in four steps. It introduces the concept of (...) negative governmentality by arguing that the idea of freedom requires both the positive affirmation of moral agency and the constraining of moral agency (Section 2). It then explores how rights constitute freedom by limiting rights or making exceptions to them (Section 3). Later, it analyses how rights‐based norms prevent abuse of rights by holders of rights (Section 4). Finally, it sees how rights‐based norms constrain the legal guarantor of rights, i.e., a state (Section 5). The essay concludes by mentioning the importance of negative governmentality (Section 6). In this article, three concepts that constitute the pillars of sciences, namely the subject, principle and problem, will be examined relying on Avicenna’s (d. 428/1037) book of Burhān. These three concepts, which generally determine the scope of scientific research and the principles on which it should be based, were introduced systematically for the first time by Aristotle (d. 322 BC) in the history of thought. Through these concepts, philosophical sciences could be distinguished from one another and it became possible for (...) each science to examine specific parts of existence. This distinction, which was also adopted by the scholars of Islamic thought, has presented such an integrity that neither philosophical disciplines nor religious sciences could remain indifferent. As a matter of fact, especially in the later period of theologicians, the information was considered as science only if it was based on these three concepts. Therefore, it can be asserted that these three concepts were considered as the measure of scientific activity, first by peripatetic philosophy and later by other disciplines. (shrink)

Recent analyses have critically evaluated the connection of abstract rights with territorial nation-states. This article extends those findings by analyzing the way discourses of rights (human, political, national) are interconnected. It is argued that the system of relations that rights establish between their norms and concrete sociopolitical practices allows rights to function as overall machinery, one that both produces and governs subjects. From this perspective, this article establishes that: (a) since rights depend for their legal guarantee on the power of (...) nation-states, they are a normative standard which coincides with the political power of a nation-state; (b) since rights require a certain ethic from subjects in order that their exercise of rights be legally protectable, they govern subjects through inclusion, that is, by structuring fields of action in order that a certain “proper” conduct may take place; (c) since the nation-state framework with which rights are connected operates in a postcolonial order, the functioning of rights is also connected with the discursive dynamics of postcoloniality. The empirical focus of the discussion is on Pakistan. The first section focuses on the use of human rights’ discourse in order to counter drone attacks in Pakistan’s tribal belt. The conundrums that human rights in this context generate are then filled in by acknowledging “rights” of a state (i.e. political sovereignty and territorial integrity), which is the focus of second section. The third section comments on the way national and political rights correspond to the notions of “citizenship” and “belongingness,” which in turn shapes the conduct of subjects in a contextually apt manner. This paper examines two objections to the infinitist theory of epistemic justification, namely “the finite mind objection” and “the distinction objection.” It criticizes Peter Klein’s response to the distinction objection and offers a more plausible response. It is then argued that this response is incompatible with Klein’s response to the finite mind objection. Infinitists, it would seem, cannot handle both objections when taken together.

Choice experiment (CE) is a questionnaire based method that the accuracy of research questionnaire determines the validity of the research outcomes. Attribute selection has a prime importance in every CE studies. If respondents do not understand or do not have preference for a certain attribute, the attribute non-attendance problem might happen that biases overall results of the research. Qualitative approaches such as literature review, focus group discussion, and in depth discussion commonly applied in CE researches. However, especially in the developing (...) countries context where ethnical and cultural diversity is a challenge in conducting survey based questionnaires, qualitative methods are not sufficient in selecting attributes. Present study investigates the application of relative importance index (RII) in respondents¡¯ preference for attributes in a modal shift study in Klang Valley, Malaysia. The 5 point Likert scale questions were employed to enhance respondents¡¯ preferences for initial 24 selected attributes. The results of this study showed that from 24 pre-selected attributes, only 18 of them had RII>0.5 and could be included in the final CE design. The results of this study could help researchers to control for unobserved problems in selecting the attributes which could not be discovered through qualitative approaches. -/- . (shrink)

It is aimed to evaluate of the effectiveness of the application of epidural steroid injection(ESE) in patients with lumbar disc herniation (LDH) in this study. Between November 2010- December 2011 patients applied Yahyalı State Hospital Algology Clinic withlow back pain for at least 3 months was evaluated in a prospective study. Application of the lumbar epidural steroid injection was planned for 150 patients. visual analogue scale (VAS) were used for scoring pain of patients. Besides, patients with hand-finger floor distance and (...) the degree of straight leg raising were evaluated before and after ESE injection. Ages of patients were between 27- 65 years old, of all patients 67 were men (44,7%), 83 were women (%55,3). Before and after treatment in VAS, direct leg increase, hand- finger ground distance of patients were found to be significantly different between measurements one by one (p=0,0037, p=0,0053, p=0,0062). Epidural steroid administration can provide earlier symptomatic treatment for the patients suffering from low back pain with lumbar disc herniation who did not respond to conservative treatment. In this paper, the scientific realism/anti-realism debate, which is one of the most popular topics in the metaphysics of science, will be examined in supporting the realistic wing. In this respect, the discussion will be conducted by keeping the subjects of ‘existence of an external mind-independent world’ and ‘unobservable entities’ at the center of this paper. In the context of understanding the world, ‘Science’ activity is not the sum of the research carried out only by considering empirical data; on the (...) contrary, it will be claimed that it is an endeavor that pursues unknown but interesting things (such as protons, photons, or viruses) and tries to give meaning to the world. Thus, against the empirical rigid attitude of anti-realism –bearing in mind the views of logical positivists; it will be illustrated that scientific realism is an understanding based on metaphysics and has a philosophical basis. In this paper, I aim to explore Lewis’s best system analysis and how it can accommodate laws with exceptions. The Best System Account has been introduced to provide an alternative view for both minimalist and counterfactual theories of regularities. Simple regularity theory faces problems in which there is some generalization that seems to be a law or some regularities that are established accidentally. The theory of science that Thomas Kuhn built in the Structure of Scientific Revolutions was considered as a hypothetical framework in this study. Since the publication of the work, many questions have arisen that call for a psychology of science. These questions are moved to another dimension through the knowledge of the decision made within Galileo Affair, which occupies an important place in modern science, fundamentally arising from an epistemic struggle and emerging out of an unscientific base rather than the (...) charge of unholiness. Abandoning the perspective which evaluates these questions within a historical process as a weak side of the Kuhnian theory of science, this study challenges the current approaches with an alternative approach. The epistemic complexity in the Kuhnian theory of science is an imperative complexity caused by human factors. From this perspective, there are potential questions for psychology of science as a field of study based on Kuhnian epistemology and it can be assumed that new problems may appear when the other epistemological questions which assumed as “answered” are reviewed in the scope of this study. This study is done in order to find the factor of depression among the college student in Malaysia. Depression among the college student are increasing as it come from many factor. This study used behavioural theory as the foundations theories for the model development. The study involved 406 respondents, selected through google form responses involving all the university students around Malaysia. A structured questionnaire was used for data collection. All variables were measured through scales previously used by other researchers. The political turmoil at the end of the period of Righteous Caliphs and in the early periods of the Umayyads had left the Islamic community facing factionalism and civil war. Accordingly, people have witnessed that the acts considered among the great sins such as assassination may be committed even by companions of the Prophet (pbuh). This situation brought the question on the status of believers who committed great sins in this World and in the Hereafter, to the agenda of scholars. (...) The Kharijis and the Mu’tazila did not consider the person who committed A great sin among the believers. According to the Ahl al-Sunna and Al-Jaṣṣās, to commit a great sin does not cause the exclusion of the person from religion. Al-Jaṣṣās has taken into account the issue of great sin, when dealing with the issues of general term, specialization of the cause and infallibilism in diligence (al-ijtihād), since it constitutes the theological (Kalāmī) side of the subject. Although al-Jaṣṣās’ followed a line close to Mu’tazila in the aforementioned matters concerning the jurisprudence, he defended the view of Abū Ḥanīfah in his approach to the person who committed a great sin. His approach to the matter of great sin also clarifies the relationship between islamic law and Islamic thought. (shrink)

In Southeast Asian countries (SEA), road transport accounts for the main energy consumption and CO2 emission. Air pollution is a major concern in densely populated cities such as Bangkok, Manila, and Kuala Lumpur. The main objective of this paper is to give insights on trends of transport development, car ownership, and CO2 emissions in Southeast Asia. This study also attempts to review the successful transportation policies around the globe and to introduce the possible instruments that can help reduce air pollution (...) in Southeast Asian countries. Economic instruments to estimate the benefits of a cleaner environment due to new policies are introduced as well. On the other hand, semantic annotation of ncRNA data is facing critical challenges due to the lack of a comprehensive ontology to serve as common data elements and data exchange standards in the field. We developed the Non-Coding RNA Ontology (NCRO) to handle this situation. Abstract: This study was aiming to determine the effect of the Vitamin A on paracetamol-induced hepatotoxicity. Fifteen rats were randomly divided into five groups; (three rats each) control group, paracetamol (1000 mg/kg body weight) was used to induce hepatotoxicity in albino rats. Vitamin A (Retinyl palmtate) administered at the dose levels of 100, 500 and1000 IU/kg body weights orally for 7 days prior to paracetamol dose. Hepatic toxicity was observed in paracetamol group; aspartate aminotransaminase (AST) level was high as compared (...) with control group (p = 0.003). The significant hepatoprotective effect of Vitamin A was observed at doses 500 and 1000 IU/kg body weight, as there was significant reduction of serum AST when compared to paracetamol group (p = 0.01 and 0.003 respectivly), where 100 IU/Kg vitamin A not significantly decrease AST. Liver trace element determined by X-ray fluorescence (XRF) (K, Ca, Fe, Cu, Zn and Rb) in paracetamol-treated group were found to be higher than that of the control group, although the only significant increase was observed with Cu. Br shows slight decrease compared to the control group. There were no significant differences between Vitamin A groups (100 mg/kg 500mg/kg and 1000mg/kg) and PCM-treated group in the liver tissue content of Ca, K, Zn, Cu, Rb and Br where Fe concentrations were significantly decrease at doses 500 and 1000IU/l (P value 0.05 and 0.045 respectively). Vitamin A shows protective effect by regulating liver tissue Fe. We recommend to perform further investigation on the mechanisms of Vitamin A hepatoprotective mechanisms of action. (shrink)

The aim of this study is to proof the argument – i.e. ‘there are significant linkages amongst tolerance, hybrid identities and migration.’ These linkages can be comprehended by means of conceptualising extensions of hybrid identities in aggregate trans/inter-migration processes. It can be put forward that arising hybrid identities are embedded in a blurring structure of thoughts, beliefs, states of affairs, facts, belongings and so forth. From multiculturalism and cosmopolitanism viewpoints, it is argued that tolerance and migration ought to be analysed (...) in frame of sociology of law, human rights, international migration law, and of course the European Union law. So far, normative arguments and soft law approaches are very much well integrated with social aspects of migration, tolerance, identity and culture. In this context, the study examines to what extent cultural and human components are protected by law in multiple levels from an interdisciplinary perspective. In this framework, it is crucial to raise the research enquiries: What are possible criteria for the limits of tolerance? To what extent tolerance is related to human rights and morality? What ought to be the limit of tolerance towards hybrid identities in multicultural and cosmopolitan societies? In a consistent manner, the criteria and standards developed by some leading scholars were reconstructed and discussed throughout this paper. These criteria and standards are both moral (part of a universal system of morality) and legal (international, supranational, or national – i.e. constitutional). In order to apply such standards their validity was discussed (i.e. the respective normative power has the norms at the various levels). In the case of morals, their difference to particular ethnic systems was established (i.e. criteria by which the two can be distinguished). Then the research argument was elaborated on whether and how the legal standards comply with the moral standards, how national standards comply with supranational or international standards. Likewise, the study highlights the crucial contributions of “World Society and World System Paradigms” that are associated with social space, global civil society, cosmopolitanism, ethnic diversity, cultural hybridity, human rights activism and public sphere. Recent debates in Refugee Studies (e.g. Syrian Refugee Crisis, Dual and Multiple Citizenship Issues and so forth) highlight the fact that the European Union needs to consider new aspects of tolerance for hybrid identities and tolerate cultural rights of hybrid identities, create cohesion in communities and establish intercultural dialogue amongst home-states and host-states. Sanguinely, the efforts of hybrid identities are strengthening the relations between home-host states and these ought to attract some considerable attention. The authors of this study hope that their endeavours may contribute somewhat towards that. (shrink)

In developing a theory of truth, as the main condition of knowledge, four issues are usually examined: definition or analysis of truth, truth bearer, truth-maker, and relation (in correspondence and coherence theories). A proper theory of truth is the one that affords the explanation of the truth of all types of propositions, and, at the same time, resists the liar paradox. The aim of this inquiry is to analyze Nasīr al-Dīn al-Tūsī’s theory of truth one who is involved both in (...) the liar paradox and in the explanation of the truth of the verity propositions and propositions that are made of intelligibles that have no instance in external world. This inquiry shows, with an analytical approach mostly systematic analysis, that he regards, against the difficulty of the lair paradox, propositions that are other than what they are about as the bearers of truth. Further, it shows that he, against the other difficulty, has two attitudes: first, he desists from the correspondence theory of truth and defines it as “ascription of an ideational thing to what, with its characteristic, is proper for it”; second, he considers the agent intellect to be the truth-maker. Although he regards the correspondence relation as an intentional relation, he does not discuss it much. One explanation could be that the issue of the correspondence relation does not play a serious part in the aforementioned difficulties. (shrink)

Nāṣir-i Khusraw (d. 481/1088), the renowned Ismāʿīlī philosopher, poet, travel writer, and missionary (dāʿī), took on the formidable challenge of showing the essential harmony between philosophy and Ismāʿīlī doctrine in his Jāmiʿ al-ḥikmatayn (The Reconciliation of Philosophy and Religion). After introducing his life and works, this chapter explores this text’s central themes and examines the manner in which Nāṣir attempts to achieve this reconciliation. Fundamental to Nāṣir’s method is a form of spiritual hermeneutics, or taʾwīl, through which he demonstrates that (...) the truths of philosophy serve as iconic representations of the spiritual truths contained in the Ismāʿīlī interpretation of Islam, thereby restoring philosophy to its original state of union with revealed, prophetic wisdom. Menschen verfügen über ein komplexes Vermögen der Selbstlokalisierung in Raum und Zeit. Seine eigene Position festzustellen kann in verschiedenen Kontexten Verschiedenes bedeuten. Nicht jedes unsere raumzeitliche Lokalisierung und Orientierung betreffende Problem ist philosophischer Natur. Fragen wie »Wo ist Norden?«, »Wie weit ist es nach Hause?« oder »In welcher Richtung liegt das Ziel?« sind lebensweltliche und gegebenenfalls navigatorische Fragen. Die kognitiven Mechanismen und Fähigkeiten zu untersuchen, die unseren Lokalisierungs- und Orientierungsleistungen zugrunde liegen, ist eine Aufgabe für die Kognitionswissenschaften. Die Untersuchung der (...) Grundlagen unserer Orientierungsfähigkeit wirft aber auch begriffliche Fragen auf, und diese zu klären ist eine philosophische Aufgabe. Wichtige Beiträge dazu haben Kant, Husserl, Strawson, Tugendhat und Gareth Evans geleistet. Truls Wyller steht in dieser Reihe und hat wie kein anderer den transzendentalphilosophischen Gehalt von Lokalisierungs- und Orientierungsfragen herausgearbeitet. Gegen naturalistische Verkürzungen hat er mit großer Beharrlichkeit dafür argumentiert, dass das Vermögen, seine eigene Position in Raum und Zeit zu bestimmen, Implika-tionen hat, die die Bedingung der Möglichkeit von Erfahrung betreffen. Die folgende Skizze ist ungleich bescheidener angelegt. Ich werde wenig mehr tun, als wesentliche Einsichten der Literatur zur raumzeitlichen Selbstlokalisierung zusammenzutragen, wobei ich einige Akzente anders setze als Wyller. Insbesondere werde ich versuchen, so weit wie möglich ohne Transzendentalen Idealismus auskommen. Im Zentrum meiner Skizze steht das klärungsbedürftige Verhältnis zwischen indexikalischen und nicht-indexikalischen Orts- und Zeitbestimmungen sowie den zugehörigen Lokalisierungsverfahren. (shrink)

In this paper I aim to re-think the question of the world of persons with schizophrenia from the perspective of the German phenomenologist Max Scheler and that of the Japanese psychiatrist Bin Kimura. So far, no comparison between these two authors has been made, even though there are several convergences and evidence of Scheler’s indirect influence on Bin Kimura through Viktor von Weizsäcker. In recent years, Dan Zahavi, Louis Sass, and Josef Parnas have interpreted the modus vivendi of schizophrenic patients (...) in relation to a disturbance on the level of the “minimal self”. Subsequently, the discussion has highlighted the importance of disorders on the level of intercorporeality and intersubjectivity (Thomas Fuchs) and on the level of “existential feelings” (Matthew Ratcliffe). This paper argues that Max Scheler and Bin Kimura allow us to focus on an aspect which has been neglected so far: that of a “relational self” that relates to the very foundation of intersubjectivity and intercorporeality and that can thus be reborn in the encounter with the other and may position itself differently in the world. In Scheler’s perspective, the world of persons with schizophrenia is the result of an axiological disorder (valueception) that impairs contact with the primordial life impulse (Lebensdrang). As a consequence, they are incapable of attuning emotionally and socially with others: this prevents the singularity from being reborn in the encounter with the other and forces them to position themselves in their own solipsistic universe. Moving in a similar direction, Bin Kimura interprets the world of persons with schizophrenia as the result of a disorder of aida (one of the central concepts of Japanese culture that indicates the space of being in between). The disorder of aida compromises the basic relationship (Grundverhältnis in the sense of Viktor von Weizsäcker) and hinders what Bin Kimura calls festum, i.e. the birth of subjectivity, so that it is experienced by persons with schizophrenia only as ante festum. Starting from these two perspectives, I argue the existence of an axiological and anthropogenetic dimension of psychopathology. I begin with a discussion of Zahavi’s concept of minimal self and the thesis that reveals the disorders on this level of subjectivity as the origin of the world of persons with schizophrenia. I, then, analyze Max Scheler’s position and its historic importance for the emergence of phenomenological psychopathology. Thereafter, I introduce the concepts of “disorder of aida” (Bin Kimura) and “disorder of ordo amoris” (Max Scheler). Finally, I develop the concept of a “psychopathology of ordo amoris” by also comparing it with Ratcliffe’s thesis of “existential feelings”. (shrink)

One of the old law/fiqh texts is Farāiz which is thought to be written by Zaid ibn Thābit (d. 45/665). In many classic texts it has been refered to this book and it is mentioned that Zaid ibn Thābit's expertising on the ilm al farāiz. But our findings show that many of researchers who study on the history of codificaditon of Islamic law have not seen this book. In this study, because of the importance of the book, we publish Zaid's (...) Farāiz and the comments written in very early period by Abu'z-Zinad (d. 130/748) on it. Thus, Risāla al Farāiz, one of the oldest fiqh texts written in the period of the Sahāba and expounded in the period of the Tābiūn, will be present to the interest of researchers. (shrink)

Neueste Predigt aus der Kirche des fundamentalistischen Naturalismus von Pastor Hofstadter. Wie sein viel berühmteres (oder berüchtigtfür seine unerbittlichen philosophischen Fehler) Werk Godel, Escher, Bach, hat es eine oberflächliche Plausibilität, aber wenn man begreift, dass dies ein grassierender Scientismus ist, der reale wissenschaftliche Fragen mit philosophischen vermischt (d.h. die einzigen wirklichen Fragen sind, welche Sprachspiele wir spielen sollten), dann verschwindet fast sein ganzes Interesse. Ich bieten einen Rahmen für die Analyse basierend auf der Evolutionspsychologie und der Arbeit von Wittgenstein (seit (...) meiner neueren Arbeit aktualisiert). Wer aus der modernen zweisystems-Sichteinen umfassenden, aktuellen Rahmen für menschliches Verhalten wünscht, kann mein Buch "The Logical Structure of Philosophy, Psychology, Mindand Language in Ludwig Wittgenstein and John Searle' 2nd ed (2019) konsultieren. Hilmi Omar Budda (1894-1952) has played a significant role in the process of institutionalization of History of Religions in Turkey. He, who was the first academician in the field of History of Religions in Turkey, lectured for many years in Dâru’l-Funûn (Ottoman University) Faculty of Divinity, which was found in 1924. Then he worked in department of Institute of Islamic Sciences, which was a branch of Istanbul University Faculty of Arts, by pursuing his same position and career. After that, Budda (...) lectured in Ankara University Faculty of Divinity, which was found in 1949, as the first academic person of the department of History of Religions. Budda, who wrote many scientific studies and trained a large number of students during his academic life roughly thirty years, filled a gap in the field of History of Religions in the early years of republic period. Even though there are some scientific problems in his writings and views on issues, this article deals with Budda’s contributions to the History of Religions and his role in the formation of such a discipline in Turkey. This study, besides, mentions about Budda’s academic sides by analyzing his scientific writings composed of books, articles and columns. (shrink)
